Misdemeanor Assault Charges in Michigan

Michigan law draws a distinction that surprises many people: you can be charged with assault even if no one was physically touched. An assault charge requires only an attempt or threat to cause physical harm that puts another person in reasonable fear of immediate contact. Battery is the actual physical touching. Both can be charged together or separately.

The two main misdemeanor tiers under MCL 750.81 and 750.81a are:

• Simple assault or assault and battery: A misdemeanor punishable by up to 93 days in jail and a fine of up to $500. No weapon and no serious injury required for the charge.
• Aggravated assault: Applies when serious or aggravated injury results, but no weapon was used and no intent to murder or cause great bodily harm is alleged. Punishable by up to 1 year in jail and a fine of up to $1,000.

A misdemeanor conviction still becomes part of your permanent criminal record, and a later conviction can result in a harsher sentence because of it.

Felony Assault Charges Under Michigan Law

When a weapon is involved or the alleged intent is more serious, Michigan prosecutors charge felonies with substantially higher penalties. Three charges come up most frequently in Grand Rapids assault cases.

Felonious Assault (MCL 750.82)
Assault with a dangerous weapon, such as a gun, knife, iron bar, brass knuckles, or club used in a manner likely to cause death or great bodily harm, is a felony punishable by up to 4 years in prison and a fine of up to $2,000. The prosecution doesn’t need to prove specific intent to kill or cause great bodily harm.

Assault with Intent to Do Great Bodily Harm or by Strangulation (MCL 750.84)
Both charges carry up to 10 years in prison and a fine of up to $5,000. The strangulation provision covers intentionally impeding normal breathing or blood circulation by applying pressure to the throat or neck or blocking the nose or mouth.

Assault with Intent to Commit Murder (MCL 750.83)
The most serious assault charge in Michigan. A conviction can result in life in prison or any term of years, and the prosecution must prove the defendant specifically intended to kill the alleged victim.

Domestic Assault Charges & the Deferred-Sentencing Option

When the alleged victim is a spouse, former spouse, dating partner, co-parent, or household member, the charge falls under Michigan’s domestic assault statute. The escalating penalty structure under MCL 750.81 works as follows: a first offense is a misdemeanor with up to 93 days in jail and a fine of up to $500; a second offense is a misdemeanor with up to 1 year in jail and a fine of up to $1,000; a third or subsequent offense is a felony with up to 5 years in prison and a fine of up to $5,000.

For eligible first-time defendants, Michigan offers a deferred-judgment option under MCL 769.4a. If the court grants a deferral and the defendant successfully completes probation, counseling, and any no-contact conditions, the charge is dismissed without a public conviction. Not everyone qualifies, and the obligations are real, but for the right situation this option may be worth pursuing.

Misdemeanor assault charges and felony preliminary examinations both begin at the 61st District Court, which has jurisdiction over the city of Grand Rapids. If a judge finds probable cause at the preliminary examination, a felony case moves to the 17th Circuit Court in Kent County for trial. Both courts sit in the Kent County Courthouse.
