Michigan Drug Laws
Michigan has some of the most severe drug laws in the United States. Even first-time offenders who are charged with simple possession can face serious consequences, including jail time and fines.
Michigan's controlled substances are classified into schedules based on factors such as their accepted medical use, potential for abuse, and scientific knowledge regarding the drug. Here is a detailed breakdown of the Michigan controlled substances schedules:
- Schedule 1:
Substances in this schedule have a high potential for abuse. They have no currently accepted medical use in the United States. There is a lack of accepted safety for use under medical supervision. Examples include LSD, Peyote, Ecstasy (MDMA), Psilocybin (Mushrooms), and Marijuana (although there are accepted medical uses for marijuana under certain conditions). - Schedule 2:
These substances also have a high potential for abuse. They have a currently accepted medical use with severe restrictions. Abuse of the substance may lead to severe psychological or physical dependence. Examples include cocaine, methamphetamine, methadone, hydrocodone, oxycodone, and fentanyl. - Schedule 3:
Substances in this schedule have a potential for abuse less than substances in Schedules 1 or 2. They have a currently accepted medical use in treatment in the United States. Abuse of the substance may lead to moderate or low physical dependence or high psychological dependence. Examples include products containing hydrocodone with aspirin or acetaminophen, and ketamine. - Schedule 4:
These substances have a low potential for abuse relative to substances in Schedule 3. They have a currently accepted medical use in treatment in the United States. Abuse of the substance may lead to limited physical dependence or psychological dependence relative to the substances in Schedule 3. Examples include Xanax, Valium, Ativan, Ambien, and Tramadol. - Schedule 5:
Substances in this schedule have a low potential for abuse relative to substances listed in Schedule 4. They have a currently accepted medical use in treatment in the United States. Abuse of these substances may lead to limited physical dependence or psychological dependence relative to the substances in Schedule 4. Examples include cough syrups with codeine, and cough medicine with ephedrine.
The classification of these substances is designed to regulate their distribution and use, aiming to prevent abuse while ensuring that they are available for legitimate medical and scientific purposes when appropriate.
Types of Drug Charges in Michigan
Possession of Schedule I or II controlled substances can lead to the following consequences:
- Possession of over 1,000 grams constitutes a felony, leading to possible penalties including life imprisonment and fines of up to one million dollars.
- Possessing from 450 to 1,000 grams can result in up to 30 years in prison and fines of $500,000.
- Quantities between 50 and 450 grams incur penalties of up to 20 years in prison and fines of $250,000.
- Possessing 25 to 50 grams is considered a felony, entailing up to 4 years in prison and fines of $25,000.
It is important to note that the charges listed above are not an exhaustive list of all possession charges in Michigan. Other factors, such as the amount of the substance in possession, can also impact the severity of the charge. In some cases, possession of larger amounts may convey an intent to deliver, resulting in more serious consequences. It is crucial to be aware of these potential charges and their potential implications when facing a possession charge in Michigan.

I am thrilled to be able to leave a rave review of my attorney Lee Coppage. Not only was he sharply dressed and his appearance spoke business but his expertise and manner in which he takes over a courtroom was amazing. I was always satisfied to know that he would definitely get my point across and my voice would be heard through him (loud and clear) every single court appearance. He helped guide me through the worse time of my adult life. I was emotionally flustered and extremely concerned about my children and their wellbeing. Lee was supportive, knowledgeable and extremely patient with me. Several times I had emotional breakdowns and the staff in Mr. Crowe's office was very respectful and tolerated everything. It was a long year for me but I am proud to say that I made the best decision by hiring the office of Wayne Crowe Jr and blessed by having Lee represent me in court during this custody battle. I am extremely satisfied with the service provided to me.- Janet Caraballo
