Penalties by Quantity

Under Michigan law, possession of Schedule I or II substances carries the most serious consequences. The penalties scale with quantity:

  • Over 1,000 grams: Up to life imprisonment and fines up to $1 million
  • 450–1,000 grams: Up to 30 years and $500,000 in fines
  • 50–450 grams: Up to 20 years and $250,000 in fines
  • 25–50 grams: Up to 4 years and $25,000 in fines

Possession of smaller amounts, and possession of Schedule III through V substances, carries lesser but still significant penalties, including potential jail time. When the quantity or surrounding circumstances suggest distribution, prosecutors may escalate the charge to possession with intent to deliver, which carries substantially harsher penalties than simple possession.

Misdemeanor possession cases in Grand Rapids are heard at the 61st District Court. Felony cases are bound over to the 17th Circuit Court at the Kent County Courthouse following a preliminary examination.
