How Michigan Classifies Repeat OWI Charges

Michigan treats a second-offense OWI as a misdemeanor when the new conviction occurs within seven years of a prior qualifying conviction. This seven-year look-back period determines whether the repeat-offense enhancement applies. The dates and nature of the prior record must be reviewed before drawing conclusions about the current charge.

A third offense is a felony under MCL 257.625(9)(c). Unlike the rule for a second offense, prior OWI convictions can count toward this felony charge without a time limit. That distinction makes an accurate review of the charging history particularly important, even when an earlier conviction occurred many years ago.

Potential Penalties for Repeat OWI Offenses

Potential sentencing depends on the offense level, the specific conviction, and decisions made during court proceedings. The statutory consequences differ substantially between a second-offense misdemeanor and a third-offense felony.

Michigan law provides the following potential penalties:

  • Second-offense incarceration: A second offense within seven years can carry five days to one year in jail. The sentence must include imprisonment, 30 to 90 days of community service, or both.
  • Second-offense fines: The court can impose a fine of $200 to $1,000.
  • Third-offense incarceration: A felony conviction can carry one to five years in prison. Another sentencing structure is probation with 30 days to one year in county jail and 60 to 180 days of community service.
  • Consecutive jail time: A third-offense sentence involving county jail requires at least 48 consecutive hours of incarceration.
  • Third-offense fines: The felony fine ranges from $500 to $5,000.
  • Vehicle consequences: Vehicle immobilization or forfeiture is mandatory after a second or subsequent conviction for OWI. When forfeiture isn’t ordered, immobilization lasts 90 to 180 days for a second offense and one to three years for a third offense.

These ranges don’t determine what will happen in a particular case. The evidence, prior record, legal issues, negotiated resolutions, and court decisions can affect the final disposition and sentence.

Driver’s License & Chemical-Test Refusal Consequences

Driver’s license sanctions and points following a conviction for OWI are imposed automatically by the Michigan Secretary of State. The criminal court can’t reduce or waive those administrative consequences. These sanctions create separate concerns alongside possible incarceration, fines, and vehicle immobilization.

Chemical-test refusal can produce additional sanctions under Michigan’s implied-consent law, which requires drivers to submit to qualifying chemical testing under specified circumstances. A first refusal carries a one-year license suspension. A second refusal within seven years results in a two-year suspension.

How We Review a Repeat OWI Case

Our defense review focuses on how the investigation began, how evidence was collected, and whether the government followed applicable legal requirements. We scrutinize the legality of the traffic stop, chemical testing procedures, and the reliability of equipment used during the investigation.

Evidence & Testing Review

We examine the available materials for inconsistencies, procedural errors, and reliability concerns that may be relevant to the defense. Our OWI work includes allegations involving alcohol or marijuana, as well as prescription drugs and some over-the-counter medications. The appropriate issues depend on the substance alleged and the type of testing used.

Arraignment, Plea Options & Trial Preparation

We guide clients through arraignment, the first court appearance where the charge and release conditions are addressed. From there, we evaluate plea options while preparing for trial when the circumstances call for it. A dismissal, reduction, negotiated plea, or trial isn’t predetermined and depends on the evidence, legal questions, and individual circumstances.

Felony Proceedings After Two Prior OWI Convictions

A felony OWI case based on two prior convictions generally begins in the district court where the arrest occurred. If the case isn’t resolved there through dismissal or a negotiated plea to a second-offense misdemeanor, it transfers to the circuit court for the county. We explain each stage and prepare clients for the decisions that may arise as the case moves forward.
